The Tooth Spa Dental Plans Terms and Conditions

 

What is included in my plan?

The essential adult plan includes 2x routine examinations with x-rays (where clinically necessary) and 2x basic scales with your dentist within a 12-month period. This plan also allows you to benefit from a 10% discount off any routine treatment.

The standard adult plan includes 2x routine examinations with x-rays (where clinically necessary). The plan also includes 2x premium scale and polish cleans and 2x airflow treatments (stain removal) with  the hygienist within a 12-month period. This plan also allows you to benefit from a 20% discount off any routine treatment.

The premium adult adult plan includes 2x routine examinations with x-rays (where clinically necessary). The plan also includes 4x premium scale and polish cleans and 2x airflow treatments (stain removal) with the hygienist within a 12-month period. This plan also allows you to benefit from a 20% discount off any routine treatment.

For children’s plans this includes 2x routine examinations, 2x fluoride varnish applications (where clinically necessary) within a 12-month period.

For example, if your plan was to start on 1st January 2023, your included examinations would be around 1st July 2023 and 31st December 2023.

What is not included in my plan?

The plans are designed to spread the cost of checkups, oral hygiene advice and prevention including cleans either with the hygienist or dentist depending on the respective plan. The plans do not cover the total cost of;

Restorative treatment e.g. fillings and crowns (Plans entitle you to either 10 or 20% discount off treatment cost).

Orthodontic treatment (Plans do not entitle you to any discounts off orthodontic treatment)

Cosmetic treatment such as composite bonding or tooth whitening (Plans entitle you to either 10 or 20% discount off treatment cost).

The provision, replacement or repair of dental implants and related superstructures (Plans do not entitle you to discounts off implant treatment)

Any treatment needed as a result of dental injury (injury to the teeth or supporting structures, including damage to dentures).

Referrals to a specialist or specialist treatment

Missed appointment or late fees, emergency consultation fees

Treatment discounts

Your plan entitles you to receive 10% or 20% off the cost of any clinically necessary treatment depending on which plan you join. The treatment must be included in your treatment plan and must be completed within 3 months of the treatment plan date.

Treatment which is not included in the discount:

Orthodontic treatment

Implant dentistry

Prescription fees

The contract does not cover pharmaceutical items, laboratory, or prescription fees.

Payment

You must pay the monthly fee by Direct Debit, with London & Zurich acting as the collecting agent on behalf of The Tooth Spa Limited. Payments will be taken on the first working day of the month. Any other payments due to The Tooth Spa Limited (eg. Prescription fees, treatment costs) are payable directly to the practice and any non-payment of such amounts will constitute a breach of the terms of the contract.

You are liable to pay the monthly fee until the contract has ended in accordance with this agreement, as detailed in point 9. Ending the Contract.

Alteration of monthly fee

The Tooth Spa Limited will review the fee of it’s Dental Plans on an annual basis. The review will consider factors such as running and material costs, and inflation. Following this review we may change the fee at our discretion. The review can be at any time of year and should an alteration be made to the fee, you will be notified by email at least one calendar month beforehand.

If you are not happy with the change in monthly fee, you have the right to terminate your contract by giving The Tooth Spa Limited at least 21 days’ notice, the 21st day being the last day of the calendar month, as detailed in point 9. Ending the Contract.

Direct Debit changes

Following a change to your monthly fee, the Direct Debit will be changed at the next available collection date. Where you are given any notice of an increase in your fee, your direct debit will be changed at the end of the required notice period, as it detailed in point 6. Alteration of monthly fee. Your bank will be notified automatically by London & Zurich.

Your responsibility

As part of the contract, you are responsible for attending your dental appointments at The Tooth Spa Limited. Should you fail to attend or cancel with less than 24 hours’ notice, you will be liable for any missed appointment or late cancellations fees.

It is your responsibility to attend the practice for your scheduled routine examinations, receive the treatment recommended by your clinician and you must advise us promptly of any injury, problem or other material matter affecting your oral health. If you fail to ensure any of this you will be liable to pay any cost reasonably charged for treatment to restore your oral health, which could otherwise have been avoided.

The Tooth Spa Limited may end the contract with immediate effect should it be our opinion that they are unable to maintain your oral health due to an act or omission on your part.

Ending the contract

Cooling off period

You can cancel the Tooth Spa Dental Plan contract during the 14 day ‘cooling off’ period. This period begins on the contract start date, or the day you receive the payment schedule whichever comes later.

Your right to cancel

You have the right to cancel the contract by giving 1 months’ notice to the practice. Notice should be given in written form by email to [email protected]. The Tooth Spa Limited may cancel your contract by giving you two months’ written notice.

If you are intending to leave the practice, you should attend a final leaving appointment where your clinician can ensure that any outstanding treatment has been completed or can be planned.

Discounted Treatment

In the event that you have received any discounted treatment and you terminate the contract within six months of receiving treatment, you will be liable to pay back the difference directly to The Tooth Spa Limited.

Non-payment

Non-payment of one fee

If you fail to make a monthly payment by Direct Debit, a member of the Tooth Spa team will be in contact to notify you. Two payments may be taken the following month or you can arrange to pay the practice directly.

Non-payment of two fees

If you fail to make two successive payments then your contract will be cancelled, effective from the date of the first failed payment. If you have received any discounted treatment, you will be liable to pay the difference as is stated in point 9. Ending the Contract—Discounted treatment.

Direct Debit Cancellation

Should you cancel your Direct Debit then no further attempt will be made by London & Zurich to take payment. Should the Direct Debit remain cancelled and you fail to make two successive payments then your contract will be cancelled.

Missed Payments

If you have any treatment during a period of missed payments you will be liable to pay the sums outstanding directly to The Tooth Spa Limited.

Variation of conditions

If it is necessary to vary the conditions of this contract, for instance, a change in the law The Tooth Spa Limited will give you 30 days’ written notice. If you do not wish to continue the contract due to these changes, you can cancel as is detailed in point 9. Ending the contract. If you do not do this within the stated time frame we will assume that you accept the changes.

Treatment outside the contract

The contract does not prevent you and your clinician from agreeing to provide treatment outside of the contract (e.g. Treatment not included in discounted treatment—tooth whitening, composite bonding). You will be responsible for paying the full cost of treatment to The Tooth Spa Limited directly as is outlined in your treatment plan.

Should you be referred to see a specialist for an opinion or treatment, these costs will not be covered by the contract and must be settled with the specialist practice directly.
